While the breast check program has been a great success, unfortunately mistakes have been made and these need to be investigated for the benefit of the patients concerned. Women diagnosed with cancer having received a negative screen result from BreastCheck are not being directly informed about internal reviews showing their mammogram X-ray was incorrectly read. There is a time lag in carrying out the reviews and BreastCheck so far is up only to 2011 in its look-back.

It also emerged earlier this month that BreastCheck has been failing to meet its own target of inviting ninety percent of women back for repeat exams every twenty four months, which has put women at risk of developing ‘interval’ cancer, cancer that develops in the two intervening years. This, and the women who were not informed of reviews of their false negative, has resulted in the BreastCheck service receiving fifteen solicitor’s letters in the last two weeks*.
The English NHS has recently become embroiled in a similar scandal, with some 450’000 women over the age of 68 missing out on exams due to their not being sent an invitation to a screening. The NHS estimates that 135 to 270 women in the group have died from breast cancer since the failure to invite them to screening tests.
Financial Blueprint of a Medical Negligence Claim
Medical Negligence cases are often a topic of conversation in Ireland. A case is built on the strength of expert reports and testimony. The ancillary costs are driven up by lack of access to salient medical records and details. This further underlines the need for mandatory disclosure and the need for patients to have live access to their own updated medical records.
At Peter McDonnell & Associates we know from experience that the single greatest cause of worry for clients is the issue of legal fees and costs. People worry that before a case commences or at the end of their case, they will be presented with a large legal bill that will be impossible to pay.
